Hong Kong Compensation for

Requisitioned Craft.

Your letter of the 16th October, 1948 (ref.A.988479/

(81) 48) addressed to faigh has been passed to me as he his

been transferred to another Divisi n of the Einistry.

While it is true, of course, that in denial action resultant damage is the same in the case of both requisitioned and unrequisitioned ships a distinction must in the view of this Hinistry, be drawn between the two groups on the question of where the liability iles.

In the case of the unrequisitioned vessels, destroyed under local Defence Regulations, it could clearly be argued that compensation should be sought from the authority in whose area the vessels were destroyed. These Regulations might not, however, provide for full compensation being payable.

Un er the terms of requisitioning adopted by this Ministry the Owner looks to the Department or to his wer risks insurance cover, if provision is made for indurah o in the Charter Party, for full compensation in the event
